Terms of Service
These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for use of the services (hereinafter referred to as the “Service”) provided on this website by the operator of the Flight Ball Information Hub (hereinafter referred to as the “Operator”). All registered users (hereinafter referred to as “Members”) shall use the Service in accordance with these Terms.
About the Service
The Service is a membership-based communication service that enables communication between the Operator and Members, as well as among Members themselves, and provides a platform operated by the Operator along with related services incidental thereto.
Article 1 (Application)
- These Terms shall apply to all relationships related to the use of the Service between Members and the Operator.
- In relation to the Service, the Operator may establish various rules and provisions (hereinafter referred to as “Individual Provisions”) in addition to these Terms. Regardless of their name, such Individual Provisions shall constitute a part of these Terms.
- In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified.
Article 2 (User Registration)
- In order to use the Service, an applicant shall apply for registration in accordance with the method prescribed by the Operator after agreeing to these Terms, and registration shall be completed upon approval by the Operator.
- The Operator may refuse to approve an application for registration if it determines that any of the following applies, and shall have no obligation to disclose the reasons:
- False information has been provided in the application
- The applicant has previously violated these Terms
- Any other case where the Operator deems the registration inappropriate
Article 3 (Management of Member ID and Password)
- Members shall properly manage their Member ID and password at their own responsibility.
- Members shall not transfer, lend, or share their Member ID and password with any third party under any circumstances. The Operator shall deem any login using a combination of Member ID and password matching registered information to be use by the Member who registered such ID.
- The Operator shall not be liable for any damages caused by the use of a Member ID or password by a third party, except in cases of willful misconduct or gross negligence by the Operator.
Article 4 (Fees and Payment Methods)
- Members shall pay the usage fees for paid portions of the Service as separately determined and displayed by the Operator on this website, using the method designated by the Operator.
- In the event of delayed payment, Members shall pay late fees at an annual rate of 14.6%.
Article 5 (Prohibited Conduct)
The Operator prohibits Members from engaging in the following acts when using the Service, in addition to those specified elsewhere in these Terms and guidelines. These prohibitions also apply to Member-submitted content.
- Acts that solicit or promote compensated dating, prostitution, or similar activities
- Distribution of child pornography or acts that may induce child abuse
- Acts for the purpose of dating or relationships
- Infringement of intellectual property rights or other rights of others
- Defamation or damage to reputation or credibility
- Encouraging self-harm, suicide, or illegal drug use
- Discriminatory expressions related to ethnicity, religion, gender, etc.
- Trading of membership status
- Unauthorized advertising or solicitation
- Acts causing disadvantage or damage to others
- Acts against public order and morals or laws
- Unauthorized reproduction or redistribution of Service information
- Providing benefits to anti-social forces
- Use for political or religious solicitation
- Dissemination of false information
- Obstruction of Service use by others
- Impersonation of others
- Infringement of intellectual property rights of Operator content
- Circumventing technical protection measures
- Providing personal information to third parties without consent
- Falsifying or deleting Service information
- Overloading servers
- Reverse engineering software
- Use or distribution of harmful programs
- Unauthorized access attempts
- Interference with Operator services
- Encouraging or facilitating the above acts
- Acts suspected of the above
- Any other acts deemed inappropriate by the Operator
Determination of whether any act falls under the above shall be at the sole discretion of the Operator.
Article 6 (Suspension, Modification, and Termination)
- The Operator may suspend or interrupt the Service without prior notice if necessary due to system maintenance, force majeure, system failure, or other reasons.
- The Operator may modify or terminate the Service at its discretion.
- The Operator shall not be liable for damages resulting from suspension or interruption.
Article 7 (Usage Restrictions and Termination)
- The Operator may restrict use or cancel registration without notice if violations or other issues occur.
- The Operator shall not be liable for damages resulting from such actions.
Article 8 (Withdrawal)
Members may withdraw from the Service in accordance with procedures prescribed by the Operator.
Article 9 (Disclaimer)
The Operator makes no warranties regarding the Service and all information is used at the Member’s own risk.
Article 10 (Compensation for Damages)
Members shall compensate the Operator for any damages caused by their actions.
Article 11 (Changes to Terms)
The Operator may modify these Terms under reasonable conditions and will notify users in advance.
Article 12 (Handling of Personal Information)
Personal information shall be handled in accordance with the Privacy Policy.
Article 13 (Notifications)
Notifications between Members and the Operator shall be made in accordance with prescribed methods.
Article 14 (Exclusion of Anti-Social Forces)
Both parties represent and warrant that they are not affiliated with anti-social forces.
Article 15 (Prohibition of Assignment)
Members may not transfer rights or obligations without prior written consent.
Article 16 (Severability)
If any provision is invalid, the remaining provisions shall remain in effect.
Article 17 (Governing Law and Jurisdiction)
These Terms shall be governed by Japanese law, and disputes shall be subject to the exclusive jurisdiction of the Nagoya District Court.
