この契約は、当方から ZIP 形式でお求めいただく場合のものです。 Microsoft Store 版は販売者が異なります（制作者の Pamo Works が 販売しています）。Store からお求めの場合は、Microsoft の「標準アプリケーション ライセンス条項」とPamo Works の利用規約が適用され、 この契約は適用されません。

第 1 条（適用）

本契約は、有限会社森山環境科学研究所（以下「当方」）が販売するソフトウェア「PlotScope」 （以下「本ソフトウェア」）を、ポータブル形式（ZIP 形式）で お求めいただく場合の使用条件を定めるものです。

本ソフトウェアを制作したのは Pamo Works です。当方は、 同者から許諾を受けて販売しています。

お客様がライセンスの発行をお申し込みになった時点で、本契約に同意された ものとみなします。

本ソフトウェアの直販版をお求めいただけるのは、 日本国内に所在する事業者（法人・団体・個人事業主）に限ります。 日本国外の方、および事業としてのご利用でない方へは販売いたしません。

第 8 条のサポートも、日本国内に所在する事業者に対してのみ ご提供します。

本ソフトウェアの画面は日本語と英語を切り替えられますが、 これは表示の話であって、販売の範囲とは別です。 日本国内の事業者のもとで、日本語を母語とされない方がお使いになることは 差し支えありません。

第 2 条（使用許諾の範囲）

当方は、お客様に対し、本契約に従って本ソフトウェアを使用する 非独占的で譲渡できない権利を許諾します。 著作権は制作者である Pamo Works に帰属します。 本ソフトウェアは、権利そのものが売られるものではありません。

第 3 条（ライセンスの発行と再発行）

ライセンスは、お客様の PC に表示される機器コードに 結び付けて発行します。機器コードはその PC を表す 16 文字で、 PC を特定できる情報や個人情報は含まれていません。

ライセンスはご所属（法人名・団体名）に対して発行します。 所属はアプリのウインドウの題に常に表示されます。

次の場合は、ライセンスの再発行が必要になります。 あらかじめご相談ください。

再発行を承るのは、ライセンスを発行した日から 1 年間です。 サポートの期間（第 8 条）と同じ区切りです。

1 年を過ぎたあとに PC を入れ替えられた場合は、 あらためてお求めいただくことになります。 そのままの PC でお使いいただくぶんには、期限はありません。

あらためてお求めいただく場合の価格は、 通常のご購入と同じです。継続や買い直しの割引はありません。

当方は個人・少人数で運営しており、何年先までも発行し続けることを お約束できません。お求めになる前に、この点をご承知おきください。

ご担当者（責任者）が交代したときは、再発行は要りません。 表示を新しいお名前に直したい場合のみ、1 年以内にお申しつけください。

ご所属が変わる場合は、あらためてお求めいただく必要があります。 組織の合併・分割・社名変更にともなう名称の変更は、 サポート期間内であれば無償で発行し直します。 別の法人・団体でお使いになる場合は、新たなライセンスをお求めください。

再発行を受けた場合は、それまでの PC での使用を停止してください。 同時に 2 台でお使いいただくことはできません。

再発行はお客様の申告に基づいて行います。当方から お客様の PC の状態を確認する手段はなく、発行済みのライセンスを 取り消す仕組みもありません。信頼のうえで成り立つ運用です。

そのため、短い期間に繰り返し再発行をご依頼いただいた場合は、 事情をお伺いすることがあります。台数を増やしてお使いになる場合は、 台数分をお求めください。

第 4 条（禁止事項）

次の行為はご遠慮ください。

オープンソースソフトウェアの部分については、第 9 条の各ライセンスが 優先します。

第 5 条（返品・キャンセル）

ライセンスを発行したあとの返品・返金はお受けできません。 お客様の PC に結び付けて発行するため、回収できないためです。

ライセンスの発行前であれば、お申し込みの取り消しを承ります。

お求めになる前にお試しください。 使い方のページから動作確認用のサンプル点群を 無償でダウンロードできます。お手元に点群が無くても、どのような結果が出るかを お確かめいただけます。

第 6 条（測定結果の位置づけ）

本ソフトウェアが出力する立木本数・樹高・樹冠面積・密度は、 点群データから推定した値であり、実測値ではありません。

本ソフトウェアが求めるのは、立木本数・樹高・樹冠面積・密度の 4 つです。 胸高直径（DBH）は取得できません。上空からの LiDAR では 幹が林冠に隠れて写らないためです。

推定の精度は、点群の密度、レーザーが地面まで届いているか、林分の状態、 入力された座標系の正しさなどによって変わります。本ソフトウェアは、 推定が当てにならない箇所を画面上で色分けして示しますので、 結果をご利用になる前にご確認ください。

測定結果を業務上の判断、報告、取引に用いる場合は、お客様の責任において、 かならず現地での検証を行ってください。本ソフトウェアの出力は、 検証の出発点であって、検証に代わるものではありません。

第 7 条（動作環境）

対応するのは 64 ビット版 Windows 11 のみです。 メモリ 8 GB 以上を推奨します。空き容量は 400 MB 程度に加え、 点群の索引用が別途必要です。

次の環境は対応しておりません。動作した場合でも、 サポートおよび第 13 条の更新版の対象外です。

OS の変更により動作しなくなる場合があります。 Windows 11 の大きな更新、機能の追加や廃止、将来の新しい Windows への 移行によって、本ソフトウェアが起動しなくなる、または正しく動作しなくなる ことがあります。

その場合に、対応した版をお出しすることを確約できません。 また、これを理由とする返金はお受けできません。この点をご承知のうえ お求めください。第 1 条のとおり、ライセンスの発行をお申し込みになった 時点で、本項にご同意いただいたものとみなします。

直販版はインストール不要のポータブル形式です。管理者権限は要りません。 発行元の証明書を付けていないため、初回起動時に Windows の警告が 出ることがあります。

第 8 条（サポートの対象範囲と期間）

サポートとライセンスの再発行をお受けできるのは、 ライセンスを発行した日から 1 年間です。

期間が過ぎても本ソフトウェアはそのままお使いいただけます。 ご使用に期限はありません。

ただし、期間が過ぎたあとに PC を入れ替えられた場合は、 あらためてお求めいただくことになります（第 3 条）。

期間内にお受けするのは次のことです。

期間が過ぎたあとのお問い合わせは、お受けできない場合、 または別途費用を申し受ける場合があります。 継続してサポートをご希望の場合は、下記の連絡先へご相談ください。

本条のサポートは、本ソフトウェアが正しく動作すること ——点群を読み込み、計算し、結果を書き出せること——についてのものです。 出力された数値が正しいことをサポートするものではありません。 三次元の情報が正しいかどうかは、第 6 条のとおり、 かならずお客様ご自身で検証してください。

当方が動作を確認しているのは、次の条件を満たす点群です。

点密度が 50 点/m² を下回ると、小さい立木の取りこぼしが増え、 樹高の平均が実際より低く出ます。

写真測量（フォトグラメトリー）による点群は、林冠に遮られて地面まで写らない ことが多く、樹高の測定には適しません。読み込むことはできますが、 サポートの対象外とさせていただきます。

当方は、本ソフトウェアが特定の目的に適合すること、および中断や不具合なく 動作することを保証するものではありません。

第 9 条（オープンソースソフトウェア）

本ソフトウェアに含まれるオープンソースソフトウェアには、それぞれの ライセンスが適用されます。詳細は本ソフトウェアの 「ヘルプ → ライセンス情報」でご確認いただけます。

Qt (PySide6) は LGPL-3.0 に基づき動的リンクで利用しており（同梱の版は 6.11.2）、同ライセンスの定めにより、差し替えて再構成するために必要なものを 当方が請求に応じて提供します（制作者の協力を得て提供します）。直販版はポータブル形式のため、 フォルダ内の Qt の DLL をご自身で差し替えることができます。

第 10 条（お客様のデータの取り扱い）

本ソフトウェアは、お客様が読み込んだ点群ファイルを書き換えません。 読み込みを速くするための補助ファイル（.idx.npz、 .rel.npz、.proj.json など）を同じ場所に作成しますが、 これらは本ソフトウェアの「ファイル → この点群の下準備を削除」から削除できます。

もっとも、いかなるソフトウェアにも不具合の可能性はあります。 重要なデータについては、あらかじめ複製をお取りいただくようお願いします。

本ソフトウェアが外部と通信するのは背景地図の取得のときのみです。詳細は プライバシーポリシーをご覧ください。

背景地図には国土地理院の地理院タイルを使用しており、国土地理院コンテンツ 利用規約に基づいて表示しています。出典は画面上に表示されます。地図を含む画面を 報告書などに転載される場合は、出典の表示をそのまま残してください。

第 11 条（ライセンスの管理について）

ライセンス ファイルには、お客様のお名前（法人名）と機器コードが 記録されます。これは当方が発行の控えとして保管し、再発行のご依頼に お応えするために用います。第三者へ提供することはありません。

本ソフトウェアがライセンスの確認のために外部と通信することはありません。 確認はお客様の PC の中だけで行われます。

第 12 条（責任の制限）

本ソフトウェアの利用によりお客様に生じた損害について、当方は、お客様が 本ソフトウェアに対して支払った金額を上限として責任を負うものとします。 ただし、当方の故意または重大な過失による場合は、この限りではありません。 また、本条は、法令によりその効力が制限される範囲においては適用されません。

第 13 条（更新版の提供）

不具合を修正した版が公開された場合は、第 8 条の サポート期間内は無償で提供します。下記の連絡先へ ご連絡いただくか、サイトからダウンロードしてください。

修正版を公開することを確約するものではありません。 新しい機能を含む版の提供も保証いたしません。将来、大きく機能を加えた版を 別の製品としてご案内する場合があります。

第 14 条（解除）

お客様が第 4 条に違反された場合、当方は本契約を解除することができます。 その場合、お客様は本ソフトウェアの使用を停止し、複製物を削除してください。

第 15 条（本契約の変更）

当方は、必要に応じて本契約を変更することがあります。変更した場合は、 このページを更新し、最終更新日を改めます。

変更後の契約は、変更後にお求めいただいた方に適用されます。すでに お求めいただいた方には、お求めの時点の契約が引き続き適用されます。 ただし、法令の改正に伴う変更、およびお客様に不利益とならない変更は、 この限りではありません。

第 16 条（準拠法・管轄）

本契約は日本法に準拠して解釈されます。

本契約に関して紛争が生じた場合は、名古屋地方裁判所を 第一審の専属的合意管轄裁判所とします。

ライセンスの発行・再発行、不具合のご報告、そのほかのお問い合わせは 下記へお願いします。日本語または英語で承ります （日本国内に所在する事業者からのお問い合わせに限ります）。

PlotScope Licence Agreement (direct sales)

This agreement applies when you buy the portable (ZIP) edition from us. The Microsoft Store edition is sold by someone else — by Pamo Works, who wrote the software. If you bought it there, Microsoft's Standard Application Licence Terms and Pamo Works' Terms of Use apply instead, and this agreement does not.

1. Scope

This agreement governs the use of PlotScope ("the Software") in its portable (ZIP) form, sold by 有限会社森山環境科学研究所 ("we", "us"). The Software was written by Pamo Works; we sell it under licence from them. By requesting a licence you accept these terms.

The direct (ZIP) edition is sold only to businesses established in Japan — companies, organisations and sole traders. We do not sell it outside Japan, or for non-business use.

Support under clause 8 is likewise provided only to businesses established in Japan.

The Software's interface switches between Japanese and English, but that is about display, not about who may buy it. People who do not read Japanese are welcome to use it within a business established in Japan.

2. Grant of licence

We grant you a non-exclusive, non-transferable right to use the Software under this agreement. Copyright remains with Pamo Works, who wrote it; the Software is licensed, not sold.

3. Issuing and re-issuing

A licence is bound to the machine code shown on your PC — 16 characters that stand for that machine. It contains no identifying or personal information.

A licence is issued to your organisation, whose name is shown in the application's title bar at all times.

If you replace the PC, the PC fails, or reinstalling Windows changes the machine code, the licence has to be re-issued. Please ask us first. Once it is re-issued, stop using the Software on the previous PC; two machines at once are not covered.

We re-issue for one year from the day the licence was issued — the same period as support in clause 8.

If you replace the PC after that year, you will need to buy again. Carrying on with the same PC has no time limit.

Buying again costs the same as a first purchase. There is no renewal or repurchase discount.

We are a very small operation and cannot undertake to keep issuing licences years into the future. Please buy only if this is acceptable to you.

If the responsible person changes, no re-issue is needed. Ask us only if you would like the displayed name updated.

If the organisation itself changes, a new licence must be purchased. A change of name following a merger, split or rebrand is re-issued free of charge within the support period; use by a different legal entity requires a new licence.

Re-issuing is based on what you tell us. We have no way to inspect your PC, and no way to revoke a licence once issued. The arrangement rests on trust.

If re-issues are requested repeatedly over a short period we may ask about the circumstances. To use the Software on more machines, please buy more licences.

4. What you may not do

For the open source components, the licences in clause 9 take precedence.

5. Refunds

Once a licence has been issued it cannot be refunded, because it is bound to your machine and cannot be taken back.

You may cancel an order before the licence is issued.

Please try the Software before buying. A sample point cloud is linked from the guide, so you can see what the results look like even if you have no cloud of your own.

6. Nature of the measurements

Tree counts, heights, crown areas and densities produced by the Software are estimates derived from point cloud data, not direct measurements.

The Software reports four figures: tree count, tree height, crown area and density. Diameter at breast height (DBH) is not measured, because airborne LiDAR sees the canopy rather than the stems beneath it.

Accuracy depends on point density, whether the scanner reached the ground, stand conditions, and the correctness of the coordinate reference system you supply. The Software shades areas where its estimates are less reliable; please review this before relying on a result.

If you use the results for professional judgement, reporting or commercial transactions, you must validate them in the field. What the Software produces is a starting point for that validation, not a substitute for it.

7. Requirements

64-bit Windows 11 only. 8 GB RAM or more recommended, about 400 MB free space plus room for point cloud indexes.

The following are not supported. Even where the Software runs, they fall outside support and outside the updates in clause 13.

A change of operating system may stop the Software from working. A major Windows 11 update, features added or withdrawn, or a move to a future version of Windows may leave the Software unable to start or unable to work correctly.

We cannot undertake to release a version that restores it, and no refund is available on this ground. Please buy only if this is acceptable to you. As set out in clause 1, requesting a licence means you accept this paragraph.

The direct edition is portable — no installation and no administrator rights. It is not code-signed, so Windows may warn you the first time you run it.

8. Scope and period of support

Support and re-issuing run for one year from the day the licence is issued.

After that the Software keeps working, with no time limit on use.

But if you replace the PC after that year, you will need to buy again (clause 3).

Within the period we handle:

After the period, enquiries may be declined or charged separately. Please contact us if you would like support to continue.

Our support covers the Software working correctly — opening a point cloud, computing, and writing out the results. It does not extend to the correctness of the figures produced. Whether the three-dimensional information is right is for you to verify, as set out in clause 6.

We have checked the Software against point clouds that are stored as LAS, LAZ or COPC, where the scanner reached the ground, at roughly 100 points/m² or more. Below about 50 points/m², smaller trees are increasingly missed and the mean height comes out lower than it should. Photogrammetry (SfM) clouds usually do not reach the ground beneath the canopy and fall outside the scope of our support.

We do not warrant that the Software is fit for any particular purpose, or that it will operate without interruption or defect.

9. Open source

Open source components are governed by their own licences, listed under Help → Open source licenses in the application. Qt (PySide6) is used under LGPL-3.0 by dynamic linking (the bundled version is 6.11.2); as that licence requires, we will provide on request what is needed to relink the application with a modified version of Qt (with the author's assistance). The direct edition is portable, so you can replace the Qt libraries in the folder yourself.

10. Your data

The Software never modifies the point cloud files you open. It writes helper files (.idx.npz, .rel.npz, .proj.json) alongside them to make reopening fast; these can be removed from File → Delete prepared files for this cloud. No software is free of defects — please keep copies of important data.

The only outbound network traffic is fetching background map tiles. See our Privacy Policy for details. Background maps are tiles published by the Geospatial Information Authority of Japan (GSI) and are shown under the GSI content terms of use; if you reproduce a view containing the map in a report, please keep the attribution visible.

11. Licence records

A licence file records your name (or company name) and machine code. We keep a copy so we can re-issue on request. We do not pass it to anyone else.

The Software does not contact us to check a licence. The check happens entirely on your PC.

12. Limitation of liability

Our liability for any loss arising from your use of the Software is limited to the amount you paid for it. This limitation does not apply to loss caused by our wilful misconduct or gross negligence, nor to the extent that applicable law restricts it.

13. Updates

Where a release that fixes defects is published, it is provided free of charge within the support period in clause 8. We do not undertake to publish fixes, nor to release versions with new features; a substantially extended version may be offered as a separate product.

14. Termination

If you breach clause 4 we may terminate this agreement, in which case you must stop using the Software and delete your copies.

15. Changes

We may revise this agreement. If we do, we will update this page and the date above. A revision applies to purchases made after it; if you have already bought a licence, the version in force at the time of your purchase continues to apply, except for changes required by law and changes that do not disadvantage you.

16. Governing law

This agreement is governed by the laws of Japan. The Nagoya District Court shall have exclusive jurisdiction at first instance.
