PlotScope 利用規約

第 1 条（適用）
本規約は、Pamo Works（以下「当方」）が提供するソフトウェア「PlotScope」 （以下「本ソフトウェア」）の利用条件を定めるものです。
本ソフトウェアは Microsoft Store を通じて提供されます。Microsoft の 「標準アプリケーション ライセンス条項」が別途適用され、同条項と本規約が 矛盾する場合は同条項が優先します。
第 2 条（使用許諾）
お客様は、本ソフトウェアを購入することにより、Microsoft の定める条件に従って 本ソフトウェアを使用する権利を得ます。本ソフトウェアの著作権は当方に帰属し、 販売されるものではありません。
本ソフトウェアに含まれるオープンソースソフトウェアには、それぞれのライセンスが 適用されます。詳細は本ソフトウェアの「ヘルプ → ライセンス情報」でご確認いただけます。 Qt (PySide6) は LGPL-3.0 に基づき動的リンクで利用しており（同梱の版は 6.11.2）、同ライセンスの定めにより、差し替えて再構成するために必要なものを請求に応じて提供します。
Microsoft Store 版（MSIX）は署名されているため、その中の Qt を差し替えることはできません。Qt をご自身で用意した版に差し替えたい場合は、差し替えられる形（圧縮ファイル）でお渡ししますので、第 7 条の連絡先までお申し出ください。
第 3 条（測定結果の位置づけ）
本ソフトウェアが出力する立木本数・樹高・樹冠面積・密度は、 点群データから推定した値であり、実測値ではありません。
本ソフトウェアが求めるのは、立木本数・樹高・樹冠面積・密度の 4 つです。 胸高直径（DBH）は取得できません。上空からの LiDAR では 幹が林冠に隠れて写らないためです。
推定の精度は、点群の密度、レーザーが地面まで届いているか、林分の状態、 入力された座標系の正しさなどによって変わります。本ソフトウェアは、 推定が当てにならない箇所を画面上で色分けして示しますので、 結果をご利用になる前にご確認ください。
測定結果を業務上の判断、報告、取引に用いる場合は、お客様の責任において、 かならず現地での検証を行ってください。本ソフトウェアの出力は、検証の出発点であって、検証に代わるものではありません。
第 4 条（サポートの対象範囲）
本条のサポートは、本ソフトウェアが正しく動作すること——点群を読み込み、計算し、結果を書き出せること——についてのものです。出力された数値が正しいことをサポートするものではありません。三次元の情報が正しいかどうかは、第 3 条のとおり、かならずお客様ご自身で検証してください。
当方が動作を確認しているのは、次の条件を満たす点群です。
- 形式が LAS、LAZ または COPC であること
- レーザーが地面まで届いていること
- 点密度がおおむね 100 点/m² 以上であること
点密度が 50 点/m² を下回ると、小さい立木の取りこぼしが増え、 樹高の平均が実際より低く出ます。
写真測量（フォトグラメトリー）による点群は、林冠に遮られて地面まで写らない ことが多く、樹高の測定には適しません。読み込むことはできますが、 サポートの対象外とさせていただきます。
当方は、本ソフトウェアが特定の目的に適合すること、および中断や不具合なく 動作することを保証するものではありません。
第 5 条（お客様のデータの取り扱い）
本ソフトウェアは、お客様が読み込んだ点群ファイルを書き換えません。
読み込みを速くするための補助ファイル（.idx.npz、
.rel.npz、.proj.json など）を同じ場所に作成しますが、
これらは本ソフトウェアの「ファイル → この点群の下準備を削除」から削除できます。
もっとも、いかなるソフトウェアにも不具合の可能性はあります。 重要なデータについては、あらかじめ複製をお取りいただくようお願いします。
本ソフトウェアが外部と通信するのは背景地図の取得のときのみです。詳細は プライバシーポリシーをご覧ください。
背景地図には国土地理院の地理院タイルを使用しており、国土地理院コンテンツ利用規約に基づいて表示しています。出典は画面上に表示されます。地図を含む画面を報告書などに転載される場合は、出典の表示をそのまま残してください。
第 6 条（責任の制限）
本ソフトウェアの利用によりお客様に生じた損害について、当方は、お客様が 本ソフトウェアに対して支払った金額を上限として責任を負うものとします。
ただし、当方の故意または重大な過失による場合は、この限りではありません。 また、本条は、法令によりその効力が制限される範囲においては適用されません。

不具合のご報告には、お使いの Windows のバージョン、本ソフトウェアのバージョン （ヘルプ → バージョン情報）、および状況をお知らせいただけると助かります。
第 8 条（返金）
購入手続きおよび返金は Microsoft が行います。返金をご希望の場合は、 Microsoft のサポートへお申し出ください。
第 9 条（本規約の変更）
当方は、必要に応じて本規約を変更することがあります。変更した場合は、 このページを更新し、最終更新日を改めます。
変更後の規約は、変更後にご購入いただいた方に適用されます。すでにご購入いただいた方には、ご購入時点の規約が引き続き適用されます。ただし、法令の改正に伴う変更、およびお客様に不利益とならない変更は、この限りではありません。
第 10 条（準拠法）
本規約は日本法に準拠して解釈されます。ただし、お客様が消費者としてお住まいの国・地域の法令にこれと異なる強行規定がある場合は、その規定が優先します。
PlotScope Terms of Use

1. Scope
These terms govern the use of PlotScope ("the Software"), provided by Pamo Works ("we", "us").
The Software is distributed through the Microsoft Store. Microsoft's Standard Application License Terms also apply; where those terms and these conflict, Microsoft's terms prevail.
2. Licence
By purchasing the Software you obtain the right to use it under the conditions set by Microsoft. Copyright in the Software remains with us; the Software is licensed, not sold.
Open source components included in the Software are governed by their own licences, listed under Help → Open source licenses in the application. Qt (PySide6) is used under LGPL-3.0 by dynamic linking (the bundled version is 6.11.2); as that licence requires, we will provide on request what is needed to relink the application with a modified version of Qt.
The Microsoft Store build (MSIX) is signed and its contents cannot be replaced. If you wish to substitute your own build of Qt, we will supply the application in a form whose libraries can be replaced (a plain archive) — please write to the address in clause 7.
3. Nature of the measurements
Tree counts, heights, crown areas and densities produced by the Software are estimates derived from point cloud data, not direct measurements.
The Software reports four figures: tree count, tree height, crown area and density. Diameter at breast height (DBH) is not measured, because airborne LiDAR sees the canopy rather than the stems beneath it.
Accuracy depends on point density, whether the scanner reached the ground, stand conditions, and the correctness of the coordinate reference system you supply. The Software shades areas where its estimates are less reliable; please review this before relying on a result.
If you use the results for professional judgement, reporting or commercial transactions, you must validate them in the field. What the Software produces is a starting point for that validation, not a substitute for it.
4. Scope of support
Our support covers the Software working correctly — opening a point cloud, computing, and writing out the results. It does not extend to the correctness of the figures produced. Whether the three-dimensional information is right is for you to verify, as set out in clause 3.
We have checked the Software against point clouds that meet all of the following:
- Stored as LAS, LAZ or COPC
- The scanner reached the ground
- Point density of roughly 100 points/m² or more
Below about 50 points/m², smaller trees are increasingly missed and the mean height comes out lower than it should.
Photogrammetry (SfM) clouds usually do not reach the ground beneath the canopy and are not suited to height measurement. They can be opened, but fall outside the scope of our support.
We do not warrant that the Software is fit for any particular purpose, or that it will operate without interruption or defect.
5. Your data
The Software never modifies the point cloud files you open. It writes helper
files (.idx.npz, .rel.npz, .proj.json)
alongside them to make reopening fast; these can be removed from
File → Delete prepared files for this cloud.
No software is free of defects. Please keep copies of important data.
The only outbound network traffic is fetching background map tiles. See our Privacy Policy for details.
Background maps are tiles published by the Geospatial Information Authority of Japan (GSI) and are shown under the GSI content terms of use. The attribution appears on the map. If you reproduce a view containing the map in a report, please keep that attribution visible.
6. Limitation of liability
Our liability for any loss arising from your use of the Software is limited to the amount you paid for it.
This limitation does not apply to loss caused by our wilful misconduct or gross negligence, nor to the extent that applicable law restricts it.
7. Support

When reporting a problem, it helps to include your Windows version, the Software version (Help → About), and what you were doing.
8. Refunds
Purchases and refunds are handled by Microsoft. Please direct refund requests to Microsoft support.
9. Changes
We may revise these terms. If we do, we will update this page and the date above.
A revision applies to purchases made after it. If you have already bought the Software, the version in force at the time of your purchase continues to apply, except for changes required by law and changes that do not disadvantage you.
10. Governing law
These terms are governed by the laws of Japan. Where you buy as a consumer and the mandatory law of your country of residence provides otherwise, that law prevails.
